Kasapa Telecom on Thursday, February 4th won the appeal it filed against Kludjeson International Limited. Kludjeson among others was contending the legitimacy of some management personnel in the company.

These included Managing Director Robert Palitz, the former Chief Financial Officer, Mr. Lung Hien Ching, and the Former Company Secretary, Trustee Services Limited. The appeal also involved other actions taken in connection with the sale of shares in the company including the change of company name from “Celltel” to “Kasapa” and the acceptance of a shareholder loan.

The Court of Appeal on Thursday through a unanimous decision ruled that all these actions and related issues were completely valid and properly done - reversing the April 25, 2007 ruling of the Accra Fast Track High Court, presided over by Justice Victor Ofoe.

The court consequently awarded a cost of five thousand Ghana cedis in favour of each of the defendants. In an interview with Citi Business, the Managing Director of Kasapa Telecom Robert Palitz said the company is "pleased the court realized the anomaly in the earlier ruling."

"After we had been sued by Mr. Kludjeson and his company for the fraud they have perpetrated against us, he filed a number of law suits against us and the only one he ever won was this particular one- Kludjeson vs. my self and the former CFO, our former company secretary and the Attorney General and won that case successfully but we filed an appeal because we believe that everything that came out of the ruling was error but we are gratified to see the court of appeal agree with us today." He said

Kasapa Telecom and Kludjeson International had been involved in a series of confrontations over the past four years in connection with the sale of some shares in the company.
